1877 Executor's Bond & Letters Testamentary for James E. Rice (#45)'s Estate

Executor’s Bond.

We. James Rice. William Rice. Anthony C. Rice. Reuben Pontious, Jane Rice, Mary Dresback, Lemuel Boggs, Scott C. Boggs, Evan C. Shelby and David Shelby of the County of Pickaway and State of Ohio, are held and firmly bound unto the State of Ohio in the just and full sum of one hundred and twenty thousand ($120,000) Dollars, for the payment whereof well and truly to be made we find ourselves, our heirs, executors, and administrators, jointly and severally, firmly by these presents. Witness, our hands and seals this first day of March A.D. 1877.

Whereas, James E. Rice late of said County of Pickaway, deceased, made his last Will and Testament which has been proven and admitted to Record by the Probate Court in and for said Pickaway County, on the 14th day of February A.D. 1877, and Whereas the said James Rice and William Rice and Anthony C. Rice appointed Executors thereof.

Now the Condition of this Obligation is such, That if the said James Rice, William Rice and Anthony E. Rice shall make and return to that Court on oath within three months, a true inventory of all the moneys, goods, chattels, rights, and credits of the Testator which are by law to be administered, and which shall have come to their possession or knowledge; and also if required by that Court, an inventory of the real estate of the deceased: and shall administer according to law and the Will of the Testator all his goods, chattels, rights, and credits, and the proceeds of all his real estate that may be sold for the payment of his debts or legacies, which shall at any time come to the possession of the Executors or to the possession of any other person for them: and also to render upon oath a just and true account of their administration within eighteen months, and at any other times when required by the Court or the law; then this obligation to be void.

Letters Testamentary.

THE STATE OF OHIO, SS.
PICKAWAY COUNTY

To all to whom these Presents shall come, Greetings:

Know ye, That this last Will and Testament of James E. Rice
late of Pickaway County, Ohio deceased, having been duly proved before the
Probate Court of said County, and by said Court allowed and admitted to Record, the said Court dothe hereby grant unto James Rice, William Rice, Anthony C. Rice (Executors named in said Will.) full power and authority to administer according to law and to the said Will, all and singular the goods, chattels, moneys, rights, and credits of said deceased. and also the proceeds of all the real estate of said deceased which they may be authorised to sell for the payment of the debts or legacies of said deceased; to collect all the debts due to, and pay those due from the estate of said deceased, so far as its means will extend and the
law require; and to do all things which may be lawfully done in the promises, to effect the just and speedy settlement of said estate.

[Note: Of those who signed the Executor’s Bond, James Rice, William Rice, and A. C. Rice(#23) were James E. Rice’s surviving sons. Reuben Pontious/Pontius was James E.'s son-in-law, widower of James E.’s daughter Margaret Rice. Jane Rice was James E. Rice’s unmarried (at that time) daughter.(She later married). Mary Dresbeck was James’ daughter and widow of Manuel Dresbeck. It is unknown what the connection Lemuel and Scott Boggs had to James E. Rice. Evan Shelby was the husband of James E.’s daughter Elizabeth Rice. David Shelby was probably Evan’s brother. (The 1850 census for Pickaway County lists Evan Shelby living with his 50 year old parents and siblings, including David Shelby).]
